C400GT serious safety issue

Today I had to file an official complaint against official dealership and BMW Motorrad Greece since my patience ran out. The reason I ran out of patience was that I was informed that I ll have to wait at least one more week to find out what is going on because the person in charge was off with educational/training leave.

Sorry to hear that you have to go that route. Does Athens have consumer protections like we do here in the USA that we refer to as "Lemon Laws?" Basically, it says they have ten days to fix it or replace it. Conversely, if the under warranty vehicle is repaired for the same reason 3 times, and the repair is covered by the terms of the warranty, the dealer may have to refund the purchaser their purchase price less established depreciation for use. That's the essence of the laws here that are different in each of the 50 states. In my state, Florida, motorcycles and other recreational vehicles are not covered, but are in most others. It stinks that you are having trouble. Just a curiosity on my part.

Unfortunately there is no such strict legislation, at least not one that happens to be aware of. There are customer protection units that I have cced in my complaint but I don’t think I can force in any way direct replacement if there is no repair in specific period of time. For now I m waiting for an official response back from BMW and after that I ll have to decide whether this may need to be escalated even further or not.

Moisture in the ECU sounds like a typical "I don't know what I'm doing" response. There is no water or moisture in the processor. The guys fishing and buying time until someone tells him something else. No BMW shop knows how to work on these.

Like one user said check your battery cables - of the last 10 bikes I've owned the all my batteries were just finger tight - another dealer problem.

I live in Georgia as well and it's been in the 20's here it could very well be the battery is cold-soaked. If the drive battery gets close to freezing it will shut down completely to prevent damage to the battery. Keep the bike in a heated garage if possible.

There is no problem of severe cold over here. So that may not be the issue.
BMW Hellas replied that replacement of the vehicle is not an option under warranty, based on the terms of warranty upon the purchase of the vehicle. So there is no such intention from BMW’s side, at least not without any legal pressure.

Still haven’t received the bike. Local consumers protection office has called my side and BMW Hellas side to meet in a call and try to work things out.
BMW Hellas’ attitude so far has been very bad, not showing any interest in after sales support and customer care. I have notified BMW Motorrad as well but they seem to act as proxies and just forward issue to local region.

That is really unfortunate. Not that my opinion matters, and I don't know all of the facts, but it sure seems like you are not being treated fairly. It's good to hear that you are at least getting some advocacy to help you resolve this. This scenario used to be commonplace here in the USA which is why they enacted the lemon laws (which don't apply to motorcycles in my state). Anyhow, I hope that your consumer protection folks can light a fire under somebody's hindside.

I guess one way or another soon there will be some kind of settlement.
It is very disappointing that they let it escalate to this point in the first place.
By the way I did some google search out of curiosity and it turns out that there are some references with bikes dying while riding but not necessarily with the same cause. It would require some further digging in forum posts around brand’s line up to now for sure if there is a pattern.
