Today, My Used 2022 C 400 GT Was Replaced By BMW With A Brand New 2023 C 400 GT. Free. What's In Your Warranty?

If those statements pique your curiosity, and you have some free time, here's the tale, in chronological order. Note that it starts LAST year, almost a year and a half ago.

[Note: some email and phone summaries have been omitted for brevity.]


05/23/2022: I call MAX BMW's Troy, NY, location, give my credit-card info for a deposit, and order a new C 400 GT. MAX is a large BMW motorcycle dealership, with two additional locations in CT and another one in NH.

06/10/2022: I take delivery of the new C 400 GT.

07/13/2022: Having faithfully and carefully adhered to the break-in requirements stipulated in the owner's manual, I have the initial break-in service performed at MAX.

09/21/2022: I enjoy this bike so much that I go to MAX and buy BMW's maximum-length extended warranty (until 06/10/2029!). That is, although the bike was not even close to being past its three-year/36,000-mile warranty, I had decided it was definitely a keeper, and as long as I had some discretionary cash, I might as well make that purchase (before I spent the money on something useful, such as wine, women, and song).

11/07/2022: I conclude my last day-trip of the season, parking the bike in the garage with 4,351 miles on it.

03/04/2023: Bike is picked up by MAX van for 6,000-mile service and new tires. This was obviously a little early for both the service and the tires, but I've developed a habit of taking care of these things in the spring, in order not to interrupt my riding season. Well, as you will see, that plan certainly went awry this year.

03/11/2023: Bike is dropped back off in van, back at my house.

04/03/2023: First ride of the season (a typical goofing-off day-trip, in this case a 192-mile loop to Hyde Park, NY).

05/11/2023: I set off on a back-road loop, with a lunch stop in Middleburgh, NY. This is the route I took (counter-clockwise):

Sometime after lunch, on the way home, I notice a distinct loss of torque and top speed. As a check, I open it up all the way, and the bike -- slowly, much slower than usual -- tops out at a speed much less than it was capable of. I check this thrice, with adequate time in between for the bike to get over any hiccups it might have: 70.0mph; (37 minutes later) 71.0mph; (and 36 minutes after that) 70.8mph.

By the way, I had not exceeded those speeds in the pre-lunch part of the ride. And also by the way, I know all of this because I have a GoPro camera running the entire time I ride bikes, and can then download the video -- with its embedded telemetry! -- once I get home. Here's the sort of information I was looking at that evening; this particular chart, for instance, shows that first 70mph reading:

Permit me a brief aside on the top speed of the C 400 GT. As some of you may know, I've done some testing in this regard. Specifically, feel free to take a look at the three videos I posted last year in this thread -- I'll wait here:


That's right: only after break-in mileage and service were past, I verified what's stated in the owner's manual, i.e., that the bike can reach 86mph. And after the engine's had another 1,000 or more miles under its belt, it can reach 89mph on level ground.

And let me state that those tests were my only tests. That is, I ran the bike WFO only for a few seconds at a minimum, and only for a few minutes at a maximum. I had yet to take it on, say, an all-day superslab run.

On the other hand, the C 400 X and GT are certainly capable of that. If you didn't read through that thread, let me note here that a friend of mine in CA took his '22 C 400 GT for an IBA-certified SaddleSore 1000 run last year. That's a 1,000-mile jaunt in less than 24 hours, after which he wrote me: "Also I am convinced you can ride this thing W.O.T. all day long."

My points here are that: A) a C 400 is definitely capable of running in the upper 80s, and; B) I didn't abuse my bike by running it WFO a few minutes now and then.

I'm done with my aside on top speeds now.

So when I (finally, slowly) get home, I call MAX for an appointment, telling the service department that something was wrong, and that I would not be riding the bike anywhere in its current condition.

The bike has 5,644 miles on it at this point.

I get an appointment date of 06/13/2023, i.e., more than a month down the road. I mention that the bike is under warranty, my sole powered-two-wheeler (well, not counting my snowblower), and so could they get me in sooner? Nope.

Could I get a loaner from them? Nope.

Could I rent a bike from them? Nope.

Fine.

I checked the oil, verified that the fan came on and off as the temp rose and fell (idling the bike in my garage), and checked the coolant. The coolant was a little low, but not drastically so; the oil and fan were up to snuff.

05/12/2023: I buy some official BMW coolant and distilled water, and manage, it turns out, to overflow the overflow tank. I was grasping at straws, I guess, thinking slightly low coolant might've been the problem, but all I really accomplished was to make a coolant puddle on the floor.

06/17/2023: Called by service dept., telling me bike is fine, test-ridden, nothing wrong. I'm thinking, "bullshit, a tech has probably never ridden one of these before, probably has no idea what a properly functioning one feels like."

Upon my politely disagreeing, I was asked to authorize further labor costs, for further investigation. I said, "certainly!"

And now for an aside on how warranty claims are first handled, at least at MAX. If I understand a conversation or two correctly at MAX -- and I think I do -- it appears that warranty claims are first treated as if they are NOT warranty claims. That is, the assumption is ... I don't know what, the customer forgot to put gas in? -- and so any work is basically considered as just a normal service request, I guess.

If a problem is eventually determined to be a warranty issue, then, sure, all parts and labor costs are covered, for all the work, before and after that determination. But until such a determination is made, the meter is ticking, so to speak.

07/11/2023: I leave for Europe, to partake of Edelweiss' Ultimate Alps Tour (https://www.edelweissbike.com/en/touren/?c=CUA). I ride a C 400 X for nine days, through hundreds of hairpins and gorgeous scenery. (Although the C 400 X is not a listed choice for this tour -- along with a Vespa 300, the C 400 X is available only for their five(?) scooter tours -- I had whined to Edelweiss over the winter, and received special one-off permission to ride it. Of the ten customer bikes -- seven two-up couples, and three of us solo riders -- I wind up in the fast half for almost all of the tour.)

07/25/2023: I go to MAX, and see that the bike was in the shop proper (as opposed to the fenced-in area outside). The service manager informs me that a tech found "shims broken off in the exhaust." BMW Motorrad had never heard of that, and wants MAX to use a boroscope to investigate further.

07/26/2023: I decide that I don't like being bikeless for possibly a whole season here in the northeast -- especially at my age -- and go to my local Royal Enfield dealership. There, I test-ride a Meteor 350 demo bike, after which I just charge the entire purchase price for a brand new one.

07/27/2023: I send email to BMW NA, CCing the owner of the four MAX dealerships, asking for replacement or reimbursement.

07/28/2023: I pick up my Meteor 350 at that dealership, and ride it home. By the way, I opt not to mention this purchase to anyone at MAX or BMW NA, lest they slack off -- as if that were possible -- on their efforts to resolve my Beemer saga.

Yet another aside, this time on the Royal Enfield.

The Meteor 350 has no windscreen, no other weather protection, no heated grips or heated seat, no storage, questionable suspension, a single disc up front that won't win any braking contests, no tach, slightly more than half the horsepower of the C 400 GT (20 vs. 34), and a top speed of 73mph.

That said, it is the most fun I've had on two wheels since, um, I picked up my first C 400 GT, 16 months ago! It is light (c. 420 lb.), flickable, slightly feet-forward (important for my aging infrastructure), and has a heel/toe shifter. I wouldn't want to pull a SaddleSore 1000 on the superslab with a Meteor 350, but for back-road riding it is an absolute blast. I now have a little over 1,800 such miles on it, and highly recommend it, if someone's looking for a back-road goofing-off bike. See https://billanddot.com/Meteor350/ for pics and captions.

08/01/2023: The same rep at BMW NA calls me back. Same story as told July 5: will investigate, get back to me in five business days. I ask about a corporate-sponsored loaner, but am told loaners come from dealers, each of which is "independently owned," nothing corporate can do about it. No mention of a replacement or reimbursement.

5:30pm: I get email from MAX dealership owner: "Able to get approval for a new C400GT for you!" In a few follow-up clarification emails, I get it established that I will get the same Callisto Gray Metallic option.

10/13/2023: I visit MAX, speak in person with owner and finance officer. I note that techs have moved many of my farkles, and the luggage rack and top case, over from the '22 to the '23 bike. (There will be some that are never moved over, which I will have to buy anew, but I can live with that, getting a brand new '23 bike.) I ask the owner what will happen to my '22, and he tells me that he's not sure; I don't press the issue.

10/16/2023: I get a we-no-longer-have-a-lien statement, regarding the '22 bike, from my credit union.

10/17/2023: I get the new insurance-card situation, started a few days ago, squared away with my insurance company (after I spot a one-character error in the VIN). Also, I am informed by the finance head at MAX that the extended warranty can't be transferred, but that I will be refunded most of the purchase price (and can then buy another one ... which I'm not doing, at least not for about three years, because of that "most" adverb, but that's another story.)

10/19/2023: I pick up the brand new '23 C 400 GT -- same colorway, as I mentioned, except now with gold brake calipers -- at MAX, and ride it home; see https://billanddot.com/C400GT/

While I am engaged signing paperwork -- DMV, BMW, insurance, etc. -- my buddy, who drove me to MAX in Troy, is chatting with a tech in the work area. The tech told him that their theory, backed by the evidence I reported earlier -- those second-hand reports that I was getting from the service manager, about "shims" and "valve springs" -- was that a valve-spring keeper had wandered astray. And then subsequent, related, damage had perhaps occurred.

Absolute final aside now.

While the finance officer is xeroxing some paperwork, I take the opportunity to sit on one of the two CE-04s in the showroom. I am impressed by the leg room, and also impressed by how much the seat feels like a sheet of plywood.

And then, everything now wrapped up, I ride the bike home, being careful not to go crazy on fresh tires.

See, that was easy, huh?

I have no idea who is eating the cost of this, MAX or BMW NA, or some combination. As you and I might infer from the 08/24/2023 entry -- the part where the owner emailed me "Able to get approval ..." -- it seems to have been a joint process. My guess is that BMW NA is picking up most or maybe all of the cost. Why the service department at MAX apparently decided not to just fix the engine, and maybe replace the exhaust, too, in the '22, I have no idea.

Regarding my getting a new bike or reimbursed for my purchase, I had done some limited research, months ago, on New York State's vehicular lemon law. That law seems to include cars but not motorcycles. (Of course, even if you buy a toaster, there are consumer laws governing its fitness for purpose, from the federal level on down, but vehicles are usually treated in a more specific manner.) Thus, it's not at all clear to me whether the replacement or reimbursement paragraph on page 29 of my warranty booklet applies to me:

And even if it does -- or a similar position was taken by MAX or BMW NA -- I wasn't charged for the 5,644 miles I had on the '22, i.e., the part that says, "... less the amount directly attributable to use of the vehicle by the owner/lessee."

(Well, you could look at my having to duplicate some of my electrical farkles on the new bike as this particular charge. Whatever: I got the new bike, and the owner at MAX told me that there was too much labor time involved for them to undertake all the transfer work. I didn't want to pay for it, and I've got some revised plans for some of those farkles, anyway.)

Thus, I have no idea how much any of this saga is transferable to other, perhaps similar, situations other folks may encounter, with any new-ish Beemer.

But that's my story, and you've now reached the end of it.

Bill, I think you just had bad luck with yours.
I did the SaddleSour 1000 in mine and was on WOT most of the time to make 1000 miles in under 24 hours.

I agree with you, or I would've attempted to insist on a reimbursement, rather than a replacement.

But they certainly took their sweet time diagnosing and resolving the issue, and I wanted to let the folks know about that.

I still love the C 400 GT: superb handling, decent power, good ergos and weather protection. And Dot still loves it for our occasional two-up trips (and has refused to make the extra effort to climb up on the Meteor, even once, as she claims its back seat is too small, anyway).

Though they moved at a glacial pace in your case, BMW Motorrad does step up to the plate regularly -- I recall several stories on this forum where they provided new bikes or engine replacements when C 650 GT mechanical chain tensioners failed.

Being an eternal optimist, I see this whole thing as a positive. With many other manufacturers this might only have been resolved through litigation. I think this is very important as many states don't have lemon laws for motorcycles. It's a big company, and though we'd like processes to be quicker, and this resolution really was not too bad comparatively. In any event, I am glad you are back in the saddle with the beemer. Now get to work, Bill. You have a lot of farkles to add to the bike!

A few minor corrections to comments, though:

1) It was only five months + a week that I was without a Beemer scooter. (Of course, fortunately, thanks to my decision-making capability, I've been having fun riding the Mighty Meteor since the end of July.)

2) No, no. Sorry I wasn't clear: the insurance company (not BMW) screwed up a digit in the VIN, when first issuing me new insurance cards. Good thing I'm retired, so I had time to check their work.

Now, regarding the ordeal, it was actually worse than I wrote. Remember this entry: "07/22/2023: I get back from Europe"? I was thinking of adding "07/25/2023: My suitcase gets back from Europe," but I didn't want to make the post excessively long, so a few things were left on the cutting-room floor.

They did not let you remove your accessories from the bike? Geesh. Those crashbars are/were 4 bills on their own.

No, it wasn't that bad. They swapped over the crashbars, too.

What was left on the old bike were the Skene lights, front and rear, so that's about $250 worth of goodies. The owner told me that it was too much free labor for them to have done that, and that insurance regs precluded my working in their shop. And I didn't want to work in their outside lot. And I didn't want to pay them, and the agreed swap date was coming up, and I just wanted to get the whole thing over with, and yada yada. So I just let it slide.

Also still on the old bike is the connector I added for the sat nav plug, to power the front LEDs.

And, last, my external USB port and the Powerlet outlet are still on the old bike. The owner and I had agreed that we'd just ignore that stuff, because removal would leave holes in the bodywork (and swapping the associated bodywork between bikes would be labor-intensive, too).

I already have a new USB port and Powerlet socket sitting on my workbench, ready for some bonding time with the new bike. I may have a lot of that over the next few months, because it's really starting to look like the end of my season (according to how I personally calculate such things).

Thank you for sharing the details. Its quite the ordeal with your C400GT. Not many manufacturers will offer a replacement.
